NAIOP of California would like to welcome NAIOP Sacramento Valley Chapter members to the eNewsletter. This email is sent every Friday from our Sacramento staff at California Business Properties Association (CBPA) and is meant to keep you up to speed on what is happening in with statewide legislative and regulatory issues in the State’s Capitol. HELP FOR EARTHQUAKE VICTIMS IN HAITI

The commercial real estate industry extends its concerns and prayers to all those impacted by the recent earthquake in Haiti. Relief organizations are on site and are asking for help. Although we know there are many organizations providing assistance and endorse going about it any way you feel comfortable, here are two easy ways you can help:

Donate $10 to the Red Cross to be charged to your cell phone bill by texting "HAITI" to "90999" or

Contribute online to the Red Cross Haiti Relief and Development Fund.
 

 

CA PASSES FIRST MANDATORY GREEN BUILDING CODE IN NATION

From the Governor’s Press Office: Continuing California’s efforts to fight climate change and protect the environment, Governor Arnold Schwarzenegger today announced the California Building Standards Commission unanimously adopted the first-in-the-nation mandatory Green Building Standards Code (CALGREEN) requiring all new buildings in the state to be more energy efficient and environmentally responsible.

Taking effect on January 1, 2011, these comprehensive regulations will achieve major reductions in greenhouse gas emissions, energy consumption and water use to create a greener California. Click here for more information.

WHY DOES INDUSTRY SUPPORT CALGREEN?

The commercial real estate industry is very supportive of building and managing sustainable buildings – in fact we are the ones building and managing them! Done correctly and cost-effectively, not only does it help the environment, it can help the bottom line. As they say, “win-win.”

More to the point, however, of why does it make policy sense to support these public state standards, is that under a whole host of environmental mandates in California (not the least of which are AB 32 and SB 375, our state’s climate change law and a law that connects land-use with carbon emissions), stricter building codes are inevitable. Therefore, we have chosen to work closely with the state to ensure that through a consensus-based process with all stakeholders welcome at the table, green building codes are environmentally strict, while remaining cost effective and technologically feasible.

Our industry also has a long track record of directly working with state agencies to elevate codes. Aside from being directly involved with the Building Standards Commission, we have worked on and supported every adoption of Title 24, emanating from the California Energy Commission. For some reason, these “green” codes have just garnered a lot more attention than efforts in the past.

CALGREEN will define what a green building is - something that was unclear in state law -- and will help quantify our industry contributions under the Climate Change Scoping Plan and all the various regulatory processes that have started – through new and existing buildings – to reduction of carbon emissions, water usage, electricity consumption, construction waste, etc.

Also, having a clear statewide standard will help our companies avoid unnecessary environmental lawsuits, have more consistent standards across the state so we don’t have to deal with a different code in every jurisdiction, and allow us to meet some of the statewide regulatory mandates that are heading our way.

Lastly, we prefer the codes to remain in the public domain as a basic service of government, to maintain transparency, and to assure even application. CALGREEN assures the continuation of that basic, transparent process.

As we come out of this downturn we want to make sure our industry is able to lead the way, and think staying on the leading – yet reasonable, cost-effective – edge of sustainable building practices is one good strategy to assure that happens.

California’s legendary energy guru, Art Rosenfeld, is ending his unprecedented service on the California Energy Commission, and as an industry we want to say “Thank You, Art!” Governor Schwarzenegger sums it up best: “Art’s legendary contributions to the fields of particle physics and energy efficiency have helped keep California at the forefront of scientific innovation and we are lucky to have had someone so talented and honorable serve on the commission for the last decade… As an energy commissioner, he has brought unparalleled expertise to the commission while working with policymakers at all levels of government to develop a more coherent policy on efficiency and guarantee a more reliable electricity future for California.”

And, the Governor has appointed two new Commissioners:

Anthony Eggert of Davis, has served as science and technology policy advisor to the chair of the California Air Resources Board since 2007. Prior to that, he served as advisor on energy and climate policy to the Office of Federal Governmental Relations for the University of California, Office of the President in 2007 and associate research director for the University of California, Davis Institute of Transportation Studies from 2002 to 2006.

Robert Weisenmiller, of Berkeley, has been principal and co-founder of the energy consulting company MRW and Associates since 1986. Prior to that, he served as co-founder and executive vice-president of Independent Power Corporation from 1982 to 1986. Weisenmiller previously served on the California Energy Commission as director of policy and program evaluation from 1980 to 1982, special projects officer from 1978 to 1980 and assistant to the commissioner from 1977 to 1978.
